When all forms of criminal appellate relief have been exhausted, a Florida Commutation of Sentence is typically the last avenue to freedom.

When an individual is convicted and sentenced in Florida, there are usually different avenues available as long as certain time and other requirements are met.  Some examples of these are direct appeals, post-conviction motions, writs of habeas corpus, etc.  When those opportunities are exhausted however, the only avenue still available is typically a Florida Commutation of Sentence.  It is a form of Clemency.

In order to pursue any forms of Florida Clemency relief, there are certain eligibility requirements that must be met.  When it comes to a Florida Commutation of Sentence, those eligibility requirements are based off of the amount of time that has passed since the sentencing date.  The amount of time that has to pass is determined by the type of sentence received.  Was that sentence minimum mandatory in nature, a life sentence, or was it just a traditional sentence?  When seeking a Florida Commutation of Sentence, you must first seek review under Rule 8 of the Florida Rules of Executive Clemency.  The specifics can be found on the Office of Executive Clemency’s website on its clemency rules page: https://www.fcor.state.fl.us/docs/clemency/clemency_rules.pdf.
